Affordable Care Act Draft 1095-C and 1094-C forms are out.
The 1095-B and 1094-B forms are also out, but unless you’re an insurance carrier, don’t worry about those.
Bottom Line Up Front! There has not been any substantial changes to the forms from the 2018 versions.
…Which is great, because must of us have mastered completing the current forms by now. Right?
While we have you here,
I would like to address a point of confusion that I’ve been hearing from various employers regarding the “repeal” of the individual mandate and an Applicable Large Employer’s (ALE) requirement to file forms for 2019.
Question: Since the repeal of the individual mandate, do employers still have to file 1095-C/1094-C forms?
Answer: YES! ALEs still need to file for 2019. And to clarify, the individual mandate hasn’t been repealed, but the penalty for non-compliance has been reduced to $0.
Potato, potah’to.
The draft 1095-C and 1094-C forms and instructions are for reference only. Finalized forms will be released in the coming months.
We’ll post another blog when they are released, so please subscribe for that update.
And finally, while we have seen filing extensions in previous years, please don’t count on it happening again. Have those 1095-Cs loaded and in the ready for release with employee W2s at the end of January.
